These Terms govern your use of TheoryXP, a UK driving-theory revision application and related account/service features provided by TheoryXP Limited (“TheoryXP”, “we”, “us” or “our”).

Please read these Terms before creating or using a TheoryXP account. They are intended to be available on our website and from within the app. If you are under 18 and anything in these Terms is unclear, ask a parent, guardian or other trusted adult to help you understand it.

These Terms are separate from the TheoryXP Privacy Policy. The Privacy Policy explains how personal information is used; it is not a request for blanket consent to data processing.

Where TheoryXP asks you to confirm these Terms as part of account/service setup, the version shown at that time is the version that applies subject to later lawful changes described below. TheoryXP keeps versioned copies so material changes can be identified.

1. About TheoryXP

TheoryXP provides educational revision tools intended to help learners prepare for the UK car theory test. Features may include topic practice, quizzes, Mock Tests, performance tracking, personalised Study Plans, Today’s Tasks, Recovery Scanner, Road Signs learning, video-case-study learning and a Highway Code reader.

TheoryXP is an independent product. It is not an official Driver and Vehicle Standards Agency (DVSA) or Driver & Vehicle Agency (DVA) app and is not endorsed or approved by either agency.

TheoryXP includes DVSA-licensed revision material where identified. Permission to reproduce licensed material does not mean that DVSA endorses TheoryXP, its learning system or any prediction about a learner’s test result.

TheoryXP may provide content for Great Britain and Northern Ireland. Where the app asks for a test jurisdiction, you are responsible for selecting the jurisdiction relevant to the test you intend to take.

2. Revision only — no guarantee of a test result

TheoryXP is a study aid. It does not guarantee that you will pass a theory test, receive particular questions in a live test, achieve a particular score, or be ready to drive safely merely because the app reports progress, confidence or readiness.

You remain responsible for studying the applicable rules and guidance, making your own decisions during the test and complying with road-traffic law and safe-driving requirements.

Do not use TheoryXP as emergency, legal, real-time navigation or driving advice while operating a vehicle.

Official rules, test arrangements and public guidance can change. TheoryXP aims to keep its service and licensed/public-source content accurate within the applicable licences, but where a current legal rule or official test arrangement matters you should also consult the relevant official source. This does not reduce any statutory right you have if paid digital content is faulty, misdescribed or otherwise fails to meet legal requirements.

3. Accounts and Guest accounts

TheoryXP may allow you to use an account linked to an email or supported sign-in provider, or to begin with a Guest account.

A Guest account uses an anonymous TheoryXP/Supabase account identifier so that server-backed progress can be stored and protected. It is not a purely local or “no account” mode.

If a Guest account does not have an email address linked to it, TheoryXP may be unable to send important account notices by email, including an advance inactivity-deletion warning.

Where supported, linking a sign-in method may preserve the same account/progress while enabling account recovery or email-based notices if an email address becomes available.

You should keep your sign-in credentials and device access secure. If you reasonably believe somebody else has accessed your account without permission, contact support@theoryxp.app promptly.

4. Account activity and inactivity deletion

TheoryXP keeps account-linked learner progress while the account remains active, subject to the Privacy Policy and any legal retention obligations that apply separately.

If there is no recorded account activity for 12 months, the account may become eligible for automatic inactivity deletion.

Where TheoryXP has an email address for the account, we send an advance inactivity warning and provide at least 30 days before deletion. If you return to TheoryXP before deletion, the inactivity period is refreshed and the pending inactivity deletion is cancelled.

For a Guest account without a linked email address, TheoryXP may be unable to send that warning. If the Guest account remains inactive for 12 months, the account and associated learner progress may therefore be deleted without an email warning.

Deleting the TheoryXP app from a device does not itself delete the TheoryXP account or server-side learner progress. You can separately use the in-app Delete Account control.

Inactivity deletion removes the stored TheoryXP account/progress; it does not by itself cancel or erase Apple’s record of an App Store purchase. Deleted TheoryXP learner progress may not be recoverable once the active deletion and applicable limited backup period have completed.

5. Purchase, price and Apple terms

TheoryXP is currently intended to be supplied as a one-off paid App Store download, not a TheoryXP subscription. The price that applies is the price shown by Apple in the App Store at the time of purchase. If the commercial model changes in future, the App Store listing and applicable terms must clearly disclose that before purchase.

Apple processes the App Store payment transaction and applies its own App Store terms, billing systems and purchase confirmation process. TheoryXP does not receive or store your payment-card number in its learner database.

Nothing in these Terms excludes, restricts or replaces statutory consumer rights or remedies that cannot lawfully be excluded.

Apple licence terms

TheoryXP is distributed through Apple’s App Store. Unless TheoryXP’s App Store product page expressly provides a custom end-user licence agreement, Apple’s Standard Licensed Application End User License Agreement applies. For a third-party app such as TheoryXP, the Standard EULA is the licence framework under which the Application Provider grants the app licence, alongside Apple’s App Store/Media Services terms for the store transaction and usage rules.

These TheoryXP Terms are separate. They govern the TheoryXP service, learner account, TheoryXP-controlled content/service features and acceptable-use rules described here. They do not replace the applicable App Store transaction terms or the Standard EULA.

Refunds and billing issues

Apple processes App Store billing. Requests concerning App Store charges or refunds should normally be made through Apple’s purchase-support process. This does not remove any consumer right or remedy that applies under law.

6. Advertising and marketing

TheoryXP currently operates without in-app advertising and does not currently use learner data for third-party behavioural advertising.

Transactional account, security, support and inactivity-warning messages are service communications. They do not by themselves mean you have agreed to receive marketing.

If TheoryXP later introduces advertising, tracking or direct marketing, the relevant privacy information, platform declarations and any required choices/consents must be put in place before that processing starts.

7. DVSA-licensed material

Certain revision questions, answer options, supporting material and media are licensed Crown copyright material from DVSA.

You receive a personal right to access protected content through TheoryXP for your own revision. You must not extract, reproduce, republish, sell, distribute, scrape, systematically copy, bypass access controls around, or build a competing question bank from protected content except where the law or applicable licence expressly permits it.

Required Crown copyright acknowledgements and licensed supporting text must be presented in the shipping product in accordance with TheoryXP’s signed DVSA licence and final implementation/review requirements.

8. Highway Code, traffic signs and other public-sector information

TheoryXP may display official GOV.UK/Highway Code or traffic-sign material made available under the Open Government Licence v3.0 or another applicable permission, except where otherwise stated.

TheoryXP may cache eligible official content on your device for app functionality. Crown copyright, source attribution, Open Government Licence conditions and identified third-party rights continue to apply.

Reuse of public-sector information does not imply government endorsement of TheoryXP.

9. Recovery Scanner

Recovery Scanner is an optional study-support feature intended to help translate failed-test feedback into revision categories.

Under the current architecture, source images and raw OCR text are processed on-device and are not uploaded to TheoryXP’s backend. You review and confirm proposed categories before confirmed category-level information is used by the learning system.

OCR and category detection can make mistakes. You should check the proposed categories before confirming them. Recovery Scanner does not connect to DVSA or DVA test systems, authenticate an official test record or predict future live-test questions.

10. Performance, Study Plan and recommendations

TheoryXP performance states, readiness/pass-confidence-style indicators, XP, streaks and Study Plan recommendations are educational tools calculated from the evidence available to the app. They are not official DVSA or DVA assessments.

TheoryXP may use learning activity such as question results, recency, coverage, hints, Recovery categories and limited behavioural signals such as response time or answer changes to personalise revision.

Response time and answer changes are secondary supporting signals. They may slightly influence revision priority, but they cannot by themselves classify a learner as Weak. They are not used to infer anxiety, emotion, health or another sensitive psychological characteristic.

Recommendations may change as you answer more questions, revisit older material, confirm Recovery categories, change study preferences or as TheoryXP makes proportionate improvements to its learning rules.

11. Connectivity, compatibility and availability

Some TheoryXP features depend on an internet connection and third-party infrastructure, including sign-in, syncing server-backed progress, account controls and some content/service requests.

Device and operating-system compatibility shown in the App Store listing forms part of the information you should review before purchase. TheoryXP may stop supporting obsolete operating-system versions where this is reasonably necessary for security, compatibility or maintainability, subject to applicable consumer law.

We aim to keep TheoryXP available and reliable, but online functions may occasionally be unavailable because of maintenance, connectivity, security work, Apple/Supabase/other provider outages or technical faults.

Third-party services and links

TheoryXP may link to official GOV.UK/DVSA services for Great Britain, nidirect/DVA services for Northern Ireland, or use third-party platform services such as Apple or Google. Those organisations may apply their own terms and privacy notices to their services. TheoryXP is not responsible for the operation or content of a third-party service that it does not control, but this does not exclude any responsibility TheoryXP has under law for its own product, representations or choice/use of service providers.

12. Product and service changes

We may make reasonable changes to TheoryXP for clearly identified purposes such as:

complying with a change in law, regulation, licence or App Store requirement;
updating DVSA/public-source content;
correcting errors or security vulnerabilities;
maintaining compatibility with supported iOS versions or infrastructure;
improving reliability, accessibility or usability; or
making proportionate product improvements that do not unfairly remove the substance of the paid service.

We will not treat this clause as a blank cheque to remove paid core functionality arbitrarily. Where a proposed change would materially reduce the nature or value of the paid service, we will consider users’ statutory rights and provide reasonable notice where practicable. If applicable law gives you a repair, replacement, price reduction, refund or other remedy, this clause does not remove it.

If a material server-backed feature has to be permanently discontinued, we will provide notice where reasonably practicable and comply with any statutory consumer remedies that apply.

13. Acceptable use

You must not:

attempt to defeat authentication, account ownership controls, rate limits or security protections;
access or attempt to access another learner’s information;
automate bulk extraction of licensed/protected content;
deliberately evade a proportionate security restriction or suspension;
transmit malicious code or material;
infringe another person’s rights; or
intentionally disrupt TheoryXP or its backend.

Restrictions and suspension

TheoryXP may restrict or suspend access where there is a reasonable and proportionate basis to do so, including:

a material or repeated breach of these Terms;
a reasonably suspected account-security, fraud or abuse risk;
attempted unauthorised access or bulk extraction of licensed material;
a need to protect users, licensed content or TheoryXP systems from a credible threat; or
a legal, regulatory, licence or platform requirement.

Where the situation is not urgent, we will normally provide a reason and a reasonable opportunity to stop or remedy the relevant conduct before a permanent restriction is imposed. Immediate action may be necessary for serious security, fraud, unlawful activity or content-protection risks.

If you believe a restriction was applied in error, contact support@theoryxp.app. Nothing in this section removes statutory remedies where a paid service is withdrawn or fails to conform to consumer law and you are not at fault.

14. Intellectual property

TheoryXP’s software, interface, branding, original graphics/content and original learning-system material are owned by or licensed to TheoryXP Limited.

Third-party and licensed material remains owned by the relevant rights holder and is used under the applicable licence or permission. Open-source components remain subject to their applicable open-source licences and notices, which TheoryXP makes available through its Licences & Acknowledgements information where required.

Nothing in these Terms transfers ownership of TheoryXP, DVSA Crown copyright material or other third-party material to you.

15. Privacy and data rights

TheoryXP handles personal information as described in the TheoryXP Privacy Policy.

TheoryXP provides account-data export and account-deletion functionality. Additional privacy/data-rights requests and data-protection complaints can be sent to support@theoryxp.app. The public Data & Account Rights page explains those controls and rights.

16. Consumer rights and liability

TheoryXP is supplied as digital content and includes server-backed service functions. If you are a consumer, applicable law gives you rights that can include requirements for digital content to be of satisfactory quality, fit for a particular purpose made known to the trader where the law applies, and as described.

Nothing in these Terms excludes, restricts or replaces statutory consumer rights or remedies that cannot lawfully be excluded. Nothing excludes or limits liability for fraud or fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded or limited.

TheoryXP is a revision aid. The absence of a guaranteed test result is not a disclaimer of our duty to supply the product/service in accordance with applicable consumer law.

We are not responsible for loss that was not reasonably foreseeable when the relevant contract was formed, or for loss caused solely by circumstances outside our reasonable control, except where the law provides otherwise. If a problem with TheoryXP causes loss or damage for which the law gives you a remedy, those legal rights remain available.

17. Ending use and account deletion

You can stop using TheoryXP at any time. Uninstalling the app does not itself submit an account-deletion request.

If you use Delete Account, TheoryXP will delete the TheoryXP account and account-linked learner data from active TheoryXP systems through its account-deletion process, subject to information that must lawfully be retained separately and limited provider backup retention as explained in the Privacy Policy.

A restriction or suspension under section 13 does not by itself remove your privacy rights, including the ability to request access to or deletion of personal information where those rights apply.

18. Changes to these Terms

We may update these Terms for legitimate reasons such as changes in law, regulatory/platform requirements, security, the service’s technical operation or proportionate product changes.

We will not use this clause to retrospectively remove rights you have already accrued. If a change materially affects your contractual rights or obligations, we will provide reasonable advance notice where practicable and, where required by law, seek fresh agreement or provide an appropriate option/remedy before the change takes effect.

Minor wording, contact-detail or clarification changes that do not materially disadvantage users may take effect when published. The effective date/version will be updated so the applicable wording can be identified.

19. Support and complaints

For ordinary product/account support or a complaint about the TheoryXP service, contact support@theoryxp.app.

For App Store billing/refund issues, Apple’s purchase-support process is normally the appropriate first route because Apple processes the transaction.

For a data-protection complaint, use the privacy complaint route described in the Privacy Policy and Data & Account Rights page. You may also complain to the Information Commissioner’s Office.

TheoryXP does not currently state that it is a member of a mandatory or voluntary consumer ADR scheme. We will not imply membership of a scheme that does not apply. If a law, regulator or binding scheme later requires TheoryXP to participate in a particular ADR arrangement, we will provide the information required at that time.

20. Governing law and courts

These Terms are governed by the law of England and Wales, but this does not deprive you of mandatory consumer protections that apply where you live.

If you are a consumer resident in:

England or Wales, you may bring proceedings in the courts of England and Wales;
Scotland, you may bring proceedings in the Scottish courts; and
Northern Ireland, you may bring proceedings in the courts of Northern Ireland.

Nothing in these Terms prevents you from relying on any mandatory right to use another court or law that applies to you as a consumer.
